INTERNATIONAL SEARCH REPORT (ISR)
Part 1:  1  2  3  4  5  6          Part 2:  A  B  C  D  E
International application No. Applicant's or agent's file reference
PCT/US2015/026588 QC140309WO
International filing date (day/month/year) (Earliest) Priority Date (day/month/year)
20 April 2015 19 May 2014
Applicant
QUALCOMM INCORPORATED
FOR FURTHER ACTION: See Form PCT/ISA/220 as well as, where applicable, item 5 below.
This international search report has been prepared by this International Searching Authority and is transmitted to the applicant according to Article 18. A copy is being transmitted to the International Bureau.
It is also accompanied by a copy of each prior art document cited in this report.
1. Basis of the report
a. With regard to the language, the international search was carried out on the basis of:
the international application in the language in which it was filed.
a translation of the international application into                                          which is the language of a translation furnished for the purposes of international search (Rules 12.3(a) and 23.1(b)).
b.
This international search report has been established taking into account the rectification of an obvious mistake authorized by or notified to this Authority under Rule 91 (Rule 43.6bis(a)).
c.
With regard to any nucleotide and/or amino acid sequence disclosed in the international application, the international search was carried out on the basis of a sequence listing filed or furnished:
2. Certain claims were found unsearchable
This international search report has not been established in respect of certain claims under Article 17(2)(a) for the following reasons:
1.
Claims Nos.:
because they relate to subject matter not required to be searched by this Authority, namely:
2.
Claims Nos.: 5-8(partially)
because they relate to parts of the international application that do not comply with the prescribed requirements to such an extent that no meaningful international search can be carried out, specifically:
Claim 5 is not clear (Art. 6 PCT) to such an extent that a meaningful search of the whole scope of claim 5 is not possible:
The term "except of every third island" used in claim 5 is vague and unclear and leaves the reader in doubt as to the meaning of the technical feature to which it refers, thereby rendering the definition of the subject-matter of said claim unclear, Article 6 PCT. It is not clear for the skilled reader how the metal island have to be counted so as to determine the third island. The description does not disclose an interpretation of what might be meant. The skilled person is not able to compare the subject matter of claim 5 and the corresponding dependent claims 6 - 8 and the prior art.
The search was therefore limited to claim 5 in the following wording (without the term "except of every third island"):
"An apparatus, comprising: a static random access memory including: a plurality of metal islands formed on a substrate and having first respective sides that are substantially aligned in a first direction and second respective sides that are substantially aligned in a second direction; a plurality of metal lines in a second layer and oriented in the first direction; and a silicon-germanium p-type metal-oxide-silicon passgate transistor including a gate coupled to a metal line in the plurality of second metal lines and a drain coupled to an island in the plurality of metal islands."

The applicant's attention is drawn to the fact that claims relating to inventions in respect of which no international search report has been established need not be the subject of an international preliminary examination (Rule 66.1(e) PCT). The applicant is advised that the EPO policy when acting as an International Preliminary Examining Authority is normally not to carry out a preliminary examination on matter which has not been searched. This is the case irrespective of whether or not the claims are amended following receipt of the search report or during any Chapter II procedure. If the application proceeds into the regional phase before the EPO, the applicant is reminded that a search may be carried out during examination before the EPO (see EPO Guidelines C-IV, 7.2), should the problems which led to the Article 17(2) declaration be overcome.
3.
Claims Nos.:
because they are dependent claims and are not drafted in accordance with the second and third sentences of Rule 6.4(a).
3. Unity of invention is lacking
4. Title of the invention
The text is approved as submitted by the applicant.
The text has been established by this Authority to read as follows:
5. Abstract
The text is approved as submitted by the applicant.
The text has been established, according to Rule 38.2, by this Authority as it appears in Box No. IV. The applicant may, within one month from the date of mailing of this international search report, submit comments to this Authority.
6. Drawings
a.
The figure of the drawings to be published with the abstract is Figure No.     2
as suggested by the applicant.
as selected by this Authority, because the applicant failed to suggest a figure.
as selected by this Authority, because this figure better characterizes the invention.
b.
none of the figures is to be published with the abstract.
