Patent Claims

1 . A shampoo composition comprising at least one oligoester ammonium salt (OAS) and at least one further cosmetically acceptable component (F), whereby the at least one oligoester ammonium salt (OAS) is obtainable by the following steps:

heating a mixture of the following components (a) to (d) under continuously removing of reaction water:

0.5 to 3.0 molar equivalents of a diethanolamine compound represented by the formula (a)

HOCH2CH— NCH— CH2OH

wherein R3 is a linear or branched Ci-C6-alkyl, preferably linear or branched Ci-C4-alkyl, more preferably methyl or ethyl;

0.5 to 1 .5 molar equivalents of a dicarboxylic acid represented by the formula (b)

wherein R2 is a linear or branched Ci-Cio-alkylene or a linear or branched C2-Cio-alkenylene, preferably C2-C8-alkylene, more preferably C4-alkylene

0.5 to 1 .5 molar equivalents of an organic triol represented by the formula (d ) or (c2)

wherein R4 is hydrogen or linear or branched Ci-C4-alkyl or hydroxy I -C1-C4- alkyl, preferably hydrogen, methyl or ethyl, more preferably hydrogen;

1 .0 molar equivalent of a monocarboxylic acid represented by formula (d)

wherein R1 is linear or branched Ci2-C24-alkyl or linear or branched C12-C24- alkenyl, preferably linear or branched Ci2-C22-alkyl or linear or branched Ci2-C22-alkenyl, more preferably C2o-C22-alkyl;

reacting the oligoester product of step (i) with a quaternization agent (e), in particular from the group of dimethyl sulfate, diethyl sulfate and alkyl halides;

optionally removing and purifying the at least one oligoester ammonium salt

(OAS).

2. The shampoo composition comprising at least one oligoester ammonium salt (OAS) according to claim 1 , in which in the diethanolamine component (a), R3 is methyl.

3. The shampoo composition comprising at least one oligoester ammonium salt (OAS) according to claim 1 or 2, in which the dicarboxylic acid (b) is selected from the group consisting of adipic acid, glutaric acid, succinic acid, sebacid acid, itaconic acid, maleic acid, and combinations thereof.

4. The shampoo composition comprising at least one oligoester ammonium salt (OAS) according to any one of the claims 1 to 3, in which the organic triol (c) is selected from the group consisting of glycerol , triethanolamine, and combinations thereof.

5. The shampoo composition comprising at least one oligoester ammonium salt (OAS) according to any one of the claims 1 to 4, in which the carboxylic acid (d) is selected from the group consisting of behenic acid, oleic acid, coconut fatty acid, linoleic acid, and combinations thereof.

The shampoo composition comprising at least one oligoester ammonium salt (OAS) according to any one of the claims 1 to 5, wherein the OAS is preferably prepared by choosing the molar ratio of the components (a), (b), (c) and (d) such that the molar equivalents of hydroxyl functions is in excess of the molar equivalents of the acid functions.

7. The shampoo composition comprising at least one oligoester ammonium salt (OAS) according to any one of the claims 1 to 6, wherein the level of cleansing ingredient is from 1 % to 20% by total weight of the active ingredient in the composition, preferably 5% to 18%, more preferably 8% to 16%.

8. The shampoo composition comprising at least one oligoester ammonium salt (OAS) according to any one of the claims 1 to 7, wherein cleansing ingredient is selected from the group consisting of non-polymeric surfactants, saponins, polymeric surfactants, and combinations thereof.

9. A shampoo composition comprising at least one oligoester ammonium salt (OAS) of formula (I) and at least one further cosmetically acceptable component (F),

R1 is a linear or branched Ci2-C24-alkyl or linear or branched C12-C24- alkenyl group;

R2 is a linear or branched Ci-Cs-alkylene or linear or branched C2-C8- alkenylene group;

A is, at least once, independently selected from compounds conforming to:

(Ci-C6-alkylene)-CR5R6-(Ci-C6-alkylene),

wherein R5 and R6 are each independently selected from the group consisting of H, OH, Ci-C6-alkyl and hydroxy-Ci-C6-alkyl;

and is, at least once, independently selected from quaternary ammonium compounds of the formula (II)

wherein R3, R4 are each independently linear or branched Ci-C6-alkyl or linear or branched hydroxy-Ci-C6-alkyl groups;

n is an integer from 1 to 30, preferably 1 to 10; and

m is an integer from 1 to 31 , preferably 1 to 10, describing the charge; t(Xp-)i/p] is a counter-ion selected from the group consisting of monovalent

anions having the formula [X"], divalent anions having the formula

[(X2~)o.5] , and trivalent anions having the formula [(X3")i/3] .

10. The shampoo composition according to claim 9, characterized in that in formula (I) A conforms to (Ci-C4-alkylene)-CR5R6-(Ci-C4-alkylene), wherein R5 and R6 are each independently selected from the group consisting of H, OH, Ci-C2-alkyl, and hydroxy-methyl.

1 1 . The shampoo composition according to claim 9 or 10, wherein in formula (I) A the group (Ci-C6-alkylene)-CR5R6-(Ci-C6-alkylene) consists of:

-CH2-CH[OH]-CH2-,

-CH2-CH[CH2OH]-CH2-,

-CH2-C[CH3][CH2OH]-CH2--CH2-C[CH2CH3][CH2OH]-CH2-, and

-CH2-C[CH2OH]2-CH2-.

12. The shampoo composition according to any one of claims 1 to 1 1 , comprising:

(i) from 0.2 wt.% to 2.0 wt.% of one or more oligoester ammonium salts (OAS) as described in any one of claims 1 to 1 1 ;

(ii) from 5 wt.% to 20 wt.% of one or more anionic surfactants, wherein the composition comprises at least one alkyl sulfate or alkyl ether sulfate;

(iii) at least 50 wt.% water; and

(iv) at least one further component selected from the group consisting of

silicone, cationic polymer, rheology modifiying agent, and an amphoteric or zwitterionic surfactant.

13. Use of an oligoester ammonium salt (OAS) obtained by a process as defined in any one of claims 1 to 8, or of an oligoester ammonium salt (OAS) of claims 9 to 1 1 as a surfactant in a shampoo composition.

14. A method of preparing a shampoo composition according to any one of claims 1 to 12, comprising the step of preparing one or more oligoester ammonium salts (OAS) as described in any one of claims 1 to 12, and mixing the OAS with one or more further components (F).

A method of treating hair, comprising:

applying the shampoo composition according to any one of claims 1 to 12 onto wet hair and then

removing the shampoo composition from the hair.
