화상 부호화 및 복호화에 적합한 블록 분할을 행함으로써, 부호화 효율을 향상시키는 기술을 제공한다. 이력 예측 움직임 벡터 후보 리스트의 모든 이력 후보를 적어도 소정의 움직임 벡터와 참조 인덱스로 충전하는 부호화 정보 격납부와, 부호화 대상 블록에 인접하는 블록의 적어도 움직임 벡터와 참조 인덱스를 머지 후보로서 포함하는 머지 후보 리스트를 생성하는 머지 후보 리스트 생성부와, 상기 이력 예측 움직임 벡터 후보 리스트에 포함되는 이력 후보를 상기 머지 후보 리스트에 머지 후보로서 추가하여 제2 머지 후보 리스트를 출력하는 이력 머지 후보 추가부와, 상기 제2 머지 후보 리스트로부터 머지 후보를 선택 머지 후보로서 선택하는 머지 후보 선택부를 구비하고, 상기 부호화 정보 격납부는, 상기 선택 머지 후보를 상기 이력 예측 움직임 벡터 후보 리스트에 이력 후보로서 추가하여 상기 이력 예측 움직임 벡터 후보 리스트를 출력한다.
